Acceptance of terms

By accessing or using Nyumba254 — including browsing listings, creating an account, posting a listing, or sending an enquiry — you agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these terms, you must not use the platform. These terms apply to all users including buyers, renters, sellers, landlords, and property agents.

You must be at least 18 years old to create an account or post a listing on Nyumba254.

What Nyumba254 is

Nyumba254 is an online property listing marketplace serving Kenya nationwide. We provide a platform for property owners and agents to advertise apartments, houses, and commercial spaces for sale or rent, and for buyers and renters to find and contact them directly.

All transactions, agreements, and negotiations happen directly between the seller and buyer. Nyumba254 takes no responsibility for the outcome of any transaction.

User accounts

To post a listing you must create a seller account. When creating an account you agree to:

• Provide accurate and truthful information including your real name, email address, and phone number
• Keep your account information up to date
• Keep your password secure and not share it with anyone
• Be responsible for all activity that occurs under your account
• Notify us immediately at hello@nyumba254.co.ke if you suspect unauthorised access to your account

We reserve the right to suspend or terminate any account that provides false information, violates these terms, or engages in fraudulent activity.

Listing rules

By posting a listing on Nyumba254 you confirm that:

• You are the owner of the property, or you are legally authorised to list it on behalf of the owner
• All information in your listing is accurate, truthful, and not misleading
• The property exists and is genuinely available for sale or rent at the price stated
• Your listing does not violate any Kenyan law or regulation
• Photos you upload are of the actual property being listed
• You will respond to genuine buyer enquiries promptly
• You will update or remove your listing when the property is no longer available

Nyumba254 reserves the right to remove any listing at any time without notice, and without a refund of listing fees, if we determine the listing violates these terms.

Listings are reviewed before going live. We aim to approve or reject listings within 2 hours of payment confirmation. We reserve the right to reject any listing that does not meet our quality or content standards.

Payments & fees

Listing fees are charged to sellers. The current fees are:

• Standard listing: KES 800 — active for 60 days
• Featured listing: KES 2,500 — active for 90 days with top placement

Payments are processed via M-Pesa. By making a payment you authorise Nyumba254 to charge the stated amount to your M-Pesa account.

Fees are subject to change. Any fee changes will be announced at least 14 days in advance on the platform. Your existing paid listing duration will not be affected by fee changes.

Nyumba254 does not charge commission on sales or rental agreements. The listing fee is the only charge from Nyumba254.

Buyers & renters

Browsing listings and sending enquiries is free. As a buyer or renter using Nyumba254 you agree to:

• Contact sellers only for genuine enquiries about properties you are interested in
• Not send spam, unsolicited commercial messages, or abusive content to sellers
• Verify the property in person before making any payment to a seller
• Conduct your own due diligence on any property before entering into an agreement

Nyumba254 does not verify the identity of all sellers or the accuracy of all listings. We encourage buyers to exercise caution and common sense in all property transactions.

Prohibited conduct

The following are strictly prohibited on Nyumba254:

• Posting false, misleading, or fraudulent listings
• Listing property you do not own or are not authorised to list
• Creating multiple accounts to circumvent a suspension or ban
• Scraping, copying, or reproducing listing data without permission
• Harassing, threatening, or abusing other users
• Using the platform to facilitate money laundering or other illegal activity
• Posting listings for property located outside Kenya
• Impersonating another person, company, or Nyumba254 itself
• Attempting to interfere with or disrupt the platform or its security
• Collecting personal data of other users without their consent

Violation of any of the above may result in immediate account termination without refund and may be reported to the relevant authorities.

Content & photos

By uploading photos or text to Nyumba254 you confirm that:

• You own the content or have the right to use it
• The content does not infringe the copyright, trademark, or other rights of any third party
• Photos are genuine photos of the property being listed — not stock images or photos of a different property
• You grant Nyumba254 a non-exclusive licence to display your content on the platform for the duration of your listing

Nyumba254 reserves the right to remove any content that violates these terms or that we determine is inappropriate, misleading, or harmful.

The Nyumba254 name, logo, and platform design are owned by Nyumba254 and may not be copied, reproduced, or used without our prior written permission.

Limitation of liability

Nyumba254 provides the platform on an "as is" and "as available" basis. We do not guarantee that the platform will be available at all times or free from errors.

To the fullest extent permitted by Kenyan law, Nyumba254 is not liable for:

• Any loss or damage arising from a transaction between a buyer and a seller
• The accuracy or completeness of any listing
• Any fraudulent listings or fraudulent sellers
• Any loss of data, profits, or business arising from use of the platform
• Any indirect, incidental, or consequential damages

Our total liability to you for any claim arising from use of the platform shall not exceed the listing fee you paid for the relevant listing.

Termination

You may close your account at any time by contacting us at hello@nyumba254.co.ke. Closing your account will remove your listings and profile from the platform. Listing fees already paid are non-refundable upon voluntary account closure.

Nyumba254 may suspend or terminate your account at any time if you violate these terms, engage in fraudulent activity, or for any other reason at our discretion. We will attempt to notify you by email before doing so except where immediate action is required.

Disputes

These terms are governed by the laws of Kenya. Any dispute arising from your use of Nyumba254 shall first be attempted to be resolved through direct communication with our team at hello@nyumba254.co.ke.

If a dispute cannot be resolved informally, it shall be submitted to the jurisdiction of the courts of Kenya.

Nyumba254 is not responsible for resolving disputes between buyers and sellers. Any dispute about a property transaction is solely between the parties involved.

Changes to terms

We may update these Terms of Service from time to time. When we do, we will update the "Last updated" date at the top of this page and notify registered sellers by email.

Your continued use of Nyumba254 after changes are posted constitutes your acceptance of the updated terms. If you do not agree to the updated terms, you must stop using the platform.

General provisions

Entire agreement. These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Nyumba254 regarding your use of the platform, and supersede any prior agreements.

Severability. If any provision of these terms is found to be unenforceable or invalid under Kenyan law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any right or provision of these terms is not a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of Nyumba254.

Assignment. You may not assign or transfer your account or any rights under these terms without our prior written consent. Nyumba254 may assign these terms in connection with a merger, acquisition, or sale of assets.

Relationship of the parties. Nothing in these terms creates any partnership, joint venture, employment, or agency relationship between you and Nyumba254.
